November 16, 2011--Orem, Utah-based FEROX, LLC, announced today that it has commenced a federal lawsuit to enforce its rights in United States Patent No. 7,959,693, a patent that covers the solid versions of FEROX's fuel additive products. The lawsuit alleges that defendant ConSeal International, Inc. makes an infringing product called “FuelFX” which it then sells to co-defendants Earth Eco Research, LLC and Green Foot Global, LLC. According to the lawsuit, Earth Eco labels the infringing product “EcoSave” and sells it to co-defendant Genesis Pure who sells it to its distributors and to the consuming public under the name “EcoPure.” The lawsuit further alleges Green Foot labels the infringing product “EnviroTabs” and sells it to its distributors and to the consuming public. Co-defendant Ward Samuel Madsen is named in the lawsuit as a Green Foot distributor and a seller of the allegedly infringing “EnviroTabs” product. The lawsuit was filed in the United States District Court for the District of Utah as Case No. 2:11-cv-01055-SA.
